Starting the 20th of April 2018, the citizens of Timişoara benefit from the first multilevel parking facility in the city; the parking facility is located in the Openville mixed-use project and it is also one of the largest of its kind in Romania.

 

The parking facility provides clients with 910 parking spaces.

 

Located next to Iulius Mall Timişoara, the new parking lot is fitted with semi-basement, ground floor and four floors. The semi-basement level of the parking facility is fitted with bike racks.

 

The multilevel parking facility is fitted with the latest access, signaling, detection and surveillance technologies.

 

The clients benefit from easy access into Iulius Mall via two pedestrian walkways that connect the parking facility and the shopping center.

PAID PARKING LOT OPERATING HOURS

Monday-Sunday, on a non-stop basis (24/7);

Depending on the occupancy rate of the parking places or other exceptional situations, access to the parking lots may be temporarily restricted.

The Openville Administration reserves the right to mark out certain areas within the parking lot and have specific rules apply thereto.

 

PAKING FEES

  • Fee (from 07:00 to 23:00): 3 (three) RON/hour of parking;
  • Nighttime fee (from 23:00 to 07:00): 1 (one) RON/hour of parking;
  • Monthly parking subscription: 300 (three hundred) RON/month;
  • The first hour is free of charge, except from 23:00 to 07.00;
  • 30 minutes free of charge for parking lot exiting maneuvers as of ticket payment.

All the aforementioned fees include VAT and apply for all types of vehicles entering within the parking lot.

! The fee is charged on a per hour basis and cannot be fractioned.

 

  1. APPLICABLE RULES
  • This parking lot is a private area and is subject to the legislation in force related to traffic on public roads;
  • Entering the Openville Parking Lot, either with an access ticket or access card, entails the acceptance of these rules;
  • Entering the Openville Parking Lot shall be made using a parking ticket or an access card; Vehicle drivers will not enter the parking lot without the ticket issued upon opening the access barrier, considering the fact that exiting the parking lot is only allowed after paying and validating the parking ticket, or without an access card that is valid as on the entry into the parking lot (and upon exiting the parking lot);
  • For the smooth running of vehicle circulation, please observe the indications on the electronic displays located in the vicinity of the parking lot access routes. The information displayed in white indicates available parking spaces, and if the parking area corresponding to that access route is fully occupied, the message will be displayed in red;
  • When you reach the entrance barrier, push the button assigned for issuing the parking ticket. If you have an access card, place it in front of the scanner located on the barrier terminal. After picking up the ticket or, as applicable, scanning your access card, wait until the barrier opens and then follow the indicators, the traffic markings and the information on the electronic displays located on the upper side of the vehicular lanes.;
  • The number of vacant spaces is posted on these displays in green;
  • The maximum traffic speed is 5 km/h;
  • The maximum allowed height of the vehicles is indicated at the parking lot entrances;
  • For safety purposes, we recommend keeping the headlights on while driving around in the parking lots;
  • All the parking lot users are bound to comply with the instructions provided by the parking lot staff;
  • The driver should park the vehicle in the space marked out for it and carefully observe all the internal signs in the parking lot and the provisions of these Rules. Each driver is bound to park the vehicle adequately, so as to occupy a single parking space and not to hinder/block users from occupying the parking spaces located in their immediate vicinity. Alternatively, if a single vehicle takes up two parking spaces, then a double hourly parking fee shall be charged theretoNon-compliance with the obligations to use the parking area adequately, namely if a vehicle is parked illegally OR blocks/hinders traffic within the parking lot OR if a single vehicle takes up two or several parking spaces, shall entitle the Openville Administration to block the vehicle and/or tow it and/or move it  from the parking lot, with the vehicle owner/holder bearing all the costs thereto, including the blocking, towing and the parking costs for the respective impounding period, as per the hourly rates provided under these Rules. For the towing of each vehicle and its relocation within the Openville Project, the client will be charged a 300 RON towing and/or moving/relocation fee, in conformity with the fee charged by the Drumuri Municipale Timişoara S.A. company, and a 100 RON release fee. Should the vehicle be towed and relocated within the parking lot of the Drumuri Municipale Timişoara S.A. company, a towing and relocation fee shall apply amounting to 500 RON and a 5 RON/day impounding fee (per each day of vehicle impounding within the respective SDM S.A. parking lot), as per the rates charged by the Drumuri Municipale Timişoara S.A. company. The Openville Administration waives any responsibility for the damages that could occur as a result of blocking/moving and/or relocating the vehicle;
  • After finding an available spot, parking the car and entering the mall/Openville Project, upon returning to the vehicle, clients are kindly reminded to pay the equivalent value of the parking fee at the automatic pay points located in the vicinity of the parking lots entrance routes. Upon payment of the parking fee, the ATM will issue the parking ticked. Clients are kindly asked to keep the parking ticket, as it certifies that the payment was made and is subsequently used for exiting the parking lot;
  • Drivers can exit the parking lot exclusively after validating and paying the parking fee, by using the access ticket or by scanning an access card (issued upon a subscription that is valid on the scanning date);
  • After paying the fee for the respective parking duration, the parking right shall be cancelled. As of operating the payment, each client is allowed 30 minutes free of charge to get to the vehicle and leave the parking lot; Alternatively, the client shall owe the fee for another hour of parking or for a longer duration, depending on the parking interval registered for the client after paying the fee and the respective costs will have to be paid;
  • The exit barriers open automatically after introducing the paid up access ticket in the reader at the barriers or by placing the access card in front of the scanner;
  • In case of loss/destruction of the ticket within a 23 hours’ term as of entrance within the parking lot, a 50 RON fee shall be paid at the Parking Lot Information Centers along with the parking fee for the relevant parking interval. If the ticket is lost/destroyed and the entrance within the parking lot was made more than 23 hours earlier, the Client shall pay a 50 RON fee at the Parking Lot Information Centers and twice the parking fee for the relevant parking interval. The user shall pay these costs at the Parking Lot Information Centers. In case of losing the parking ticket, the driver must accurately indicate the parking space number and the relevant parking level corresponding to the lost parking ticket for the purpose of identifying it in the automated system.
  • The maximum amount of time a car may remain in the parking lot is 23 hours. Also, as an additional condition, for the parking spaces with special reserved status, vehicles may remain in the parking lot until Monday morning at 6:00 a.m. at the latest. After this maximum parking interval, the Openville Administration reserves the right to block and/or relocate the vehicle, with the vehicle driver bearing all the costs thereto, including the release and/or relocation fee and the corresponding parking costs (calculated as per the rates provided under these Rules). For the towing of each vehicle, the client is charged the 300 RON fee for towing and relocation within the Openville Project, in conformity with the fee charged by the Drumuri Municipale Timişoara S.A. company, and a 100 RON release fee. Should the vehicle be towed and relocated within the parking lot of the Drumuri Municipale Timişoara S.A. company, a towing and relocation fee shall apply amounting to 500 RON and a 5 RON/day impounding fee (per each day of vehicle impounding within the respective SDM S.A. parking lot), as per the rates charged by the Drumuri Municipale Timişoara S.A. company. The Openville Administration waives any responsibility for the damages that could occur as a result of blocking/releasing/towing/relocating the vehicle. 
  • Bicycles, scooters, motorcycles and other moped type vehicles shall be parked in the specially fitted and signalized areas and may remain parked for maximum 23 hours. Parking bicycles otherwise than in the signalized spaces or for more than 23 hours shall entitle the parking lot administration to block and/or relocate the bicycle within the parking lot, with the bicycle owner bearing all the costs thereto, namely a 50 RON fee and the parking costs for the respective parking interval. Parking scooters, motorcycles otherwise than in the signalized spaces or for more than 23 hours shall entitle the parking lot administration to block and/or relocate the vehicle within the parking lot, with its owner bearing all the costs thereto, namely the parking costs for the respective parking interval and the towing and relocation fee within the Openville Project, and amounting to 300 RON, in conformity with the fee charged by the Drumuri Municipale Timişoara S.A. company, and a 100 RON release fee. Should the vehicle be towed and relocated within the parking lot of the Drumuri Municipale Timişoara S.A. company, a towing and relocation fee shall apply amounting to 500 RON and a 5 RON/day impounding fee (per each day of vehicle impounding within the respective SDM S.A. parking lot), as per the rates charged by the Drumuri Municipale Timişoara S.A. company. The Openville Administration waives any responsibility for the damages that could occur as a result of blocking and/or relocating the vehicle.
  • Any damages occurring within the parking lot shall entail the liability of the person causing said damage and the obligation to remedy and/or bear the costs for such remedy.
  • The Openville/ATT Administration may group, divide or relocate the parking spaces within the Openville Parking Lot, for the expansion and modernization purposes or for any other commercial purposes. During the performance of such operations, the access to the parking lot based on tickets may be restricted and, if necessary, the use of cards may be disrupted.
  • The parking lot is fitted with video surveillance. The sole purpose of the surveillance cameras is to monitor the vehicle flows and the recorded footage is not available for the public;
  • The parking lot administration waives any and all responsibility regarding the integrity of the vehicles and goods left therein;
  • All the fees provided in these Rules contain VAT.
  • The following aspects are forbidden within the Openville Parking Lot:
    • parking in places where stopping and/or parking is prohibited;
    • parking on access/evacuation routes;
    • parking on the spaces that are marked out and reserved for vehicles belonging to people with limited mobility or for disabled people, except for the people having such right thereto and with a visibly displayed documentary proof;
    • non-compliance with the signage and markings within the parking lot area;
    • parking on the parking spaces designated for the police, fire squad, or ambulance intervention vehicles,  without having such right thereto;
    • access and circulation of vehicles fitted with LPG systems, oversized vehicles, animal traction vehicles, as well as vehicles with attached trails or any visible defects;
    • access to the parking lot with vehicles for the purpose of carrying out the driving lessons afferent to driver’s education;
    • leaving unattended underage children, animals, flammable substances or hazardous items in the vehicles;
    • smoking;
    • performing vehicle repairs or any vehicle maintenance activities (e.g. antifreeze or oil change) or filling the gas tank;
    • pedestrian access on the vehicles’ access routes; pedestrian access shall be made via the access routes/lanes with signage indicating use thereof by pedestrians;
    • displaying vehicles for sale purposes or parking vehicles with “for sale” ads;
    • storing any materials, products, items, etc. in any area of the parking lot.

 

  1. PARKING LOT ACCESS RULES – APPLICABLE TO THE TENANTS OF UNITED BUSINESS CENTER OFFICE BUILDINGS IN OPENVILLE
  • Regarding the parking spaces assigned to the Tenants in the UNITED BUSINESS CENTER Timișoara Buildings within Openville based on the lease agreements for office premises, the Tenants and/or their Authorized Persons use such parking spaces based on separate Parking Rules designed for the Office Building Tenants, which shall be posted in the parking areas within Openville and specially marked out for use by the Tenants of the United Business Center Buildings.

 

  1. SPECIFIC AND/OR ADDITIONAL RULES APPLICABLE ONLY TO CLIENTS THAT SIGNED A PARKING LOT ACCESS AGREEMENT FOR MONTHLY SUBSCRIPTION

    The users/beneficiaries of a parking subscription are subject to the generally applicable rules provided under Section I under these Rules and rules under Section III herein.

    Monthly subscriptions can be purchased from the Parking Lot Information Centers, based on subscriptions availability as on the date of request. The Openville Administration reserves the right to decide the method for purchasing the monthly subscriptions and to limit the number of subscriptions, reported to the operational and management needs or other aspects for optimizing the operation of locations within the Openville Project.

    Purchasing a monthly subscription entitles the subscription holder to park as per the availability of parking spaces at the time of accessing the parking lot and does not ensure the holder with a reserved or nominal parking space.

    The Openville Administration waives the obligation to guarantee a certain number of available parking spaces or to reserve a parking space for the subscription holder. Signing a monthly subscription agreement entitles the beneficiary to access the parking lot using the access card issued to the holder and based on the availability of the parking spaces.

    For each subscription including the issuance of one access card, the user/beneficiary is bound to indicate the plate number and the make of the vehicle, and it is not entitled to use the card to park another vehicle in the parking lot.

    Vehicles may be parked for a maximum period of 23 consecutive hours. If this maximum parking period is exceeded, the access card will be blocked, the monthly subscription will be cancelled, and, as of the 24th hour of parking, the fee provided under these Rules shall apply and the Openville Administration is entitled to block and relocate the vehicle. For the towing of each vehicle and its relocation within the Openville Project, the client will be charged a 300 RON towing and/or moving/relocation fee, in conformity with the fee charged by the Drumuri Municipale Timişoara S.A. company, and a 100 RON release fee. Should the vehicle be towed and relocated within the parking lot of the Drumuri Municipale Timişoara S.A. company, a towing and relocation fee shall apply amounting to 500 RON and a 5 RON/day impounding fee (per each day of vehicle impounding within the respective SDM S.A. parking lot), as per the rates charged by the Drumuri Municipale Timişoara S.A. company. The Openville Administration waives any responsibility for the damages that could occur as a result of blocking/releasing/moving and/or relocating the vehicle. Should the user subsequently wish to access the parking lot based on a subscription, the user shall have to purchase a new subscription and bear the respective costs.

    Loss or destruction of the access card shall be charged a 25 RON fee. In case of loss of the access card, the Parking Lot Information Center shall be notified in order to block the respective card.

    The parking card is personal and not transferable to anyone else.

    • ATTRIUS DEVELOPMENTS S.R.L. („ATT”) reserves the right to assign/novate the agreement or any of the rights therein, including the debts to be received under the agreement, to any third party without the prior consent of or notice to the Beneficiary. The Beneficiary unconditionally consents to this future assignment/novation of the agreement and accepts that ATT shall be completely free of any and all obligations incumbent on it as per the agreement, and such obligations shall be transferred onto the assignee;
    • Should the Openville/ATT Administration conduct certain works and this require the immediate disruption of the use of access cards during the performance of such operations, the Beneficiary shall receive a discount for the payment of the Price equal to the full value of the Price owed as per the agreement during the performance of the works by ATT, with any other objections, implications, claims, demands and remedies, coercive measures, foreclosure and cessation of the Agreement  that could have been invoked by the Beneficiary for these reasons being expressly removed;
    • ATT is entitled, with a 2 (two) days’ prior notice, to unilaterally denounce the parking lot access agreement in respect of the parking lot subscription and shall reimburse the user/beneficiary for the value of the subscription calculated on a pro rata basis for the period remaining until the expiry of the subscription,  with any other objections, implications, claims, demands and remedies, coercive measures, foreclosure and cessation of the Agreement  that could have been invoked by the Beneficiary for these reasons being expressly removed;
    • Subject to the sole condition that ATT proves that the Beneficiary did not execute, executed with delay and/or inadequately one or more of its obligations under the agreement and/or the Parking Lot Rules, the Beneficiary shall reimburse ATT for any expenses, damages and liabilities arising directly or indirectly from any breach of an obligation pertaining to the Beneficiary, under the Agreement and/or the Parking Lot Rules;
    • The Openville/ATT Administration reserves the right to limit the number of subscriptions, reported to the operational needs, those regarding the parking lot management or other aspects;
    • The Beneficiary is in delay as of right in relation to the performance of any and all of its obligations provided under the Agreement as of their due dates.

The Openville Administration reserves the right to unilaterally amend these Rules!
